Rekonstruksi Hukum Lingkungan Indonesia Melalui PendekatanTeori Hukum Progresif Satjipto Rahardjo

Abstract
This article examines the urgency of reconstructing Indonesia's environmental law through the lens of Satjipto Rahardjo's Progressive Legal Theory. The current state of national environmental law, which remains formalistic, reactive, and fragmented across various sectoral regulations, has proven inadequate in responding to the escalating ecological crisis. This research employs a normative juridical method with conceptual and comparative approaches, analyzing the prevailing regulatory framework, landmark judicial decisions, and progressive legal doctrine as reconstructive instruments. The findings indicate that the progressive approach creates space for judges and policymakers to place ecological justice as the highest value in dispute resolution and environmental norm-setting. The reconstruction encompasses three main pillars: (1) ecosystem-based legislative renewal, (2) restorative and preventive law enforcement, and (3) participatory institutional arrangements involving indigenous and civil communities. This article contributes an operational conceptual framework for a more ecologically and socially responsive reform of Indonesia's environmental law.
